Terms & Conditions

Effective 14 August 2026. These terms govern the ImageSure website, scans, reports and image-creation services.

1. Who we are

ImageSure (“ImageSure”, “we”, “us”) operates image-sure.com and supplies the services described below.

2. Accepting these terms

By using the site, submitting a URL, requesting a scan, placing an order or supplying a brief, you agree to these terms and our Privacy Policy. If you act for an organisation, you confirm that you have authority to bind it. You must be at least 18 and legally able to enter a contract.

If you do not agree, do not submit a URL or order a service.

3. The services

3.1 Free initial scan

The free scan samples a limited number of publicly accessible pages and extracts technical indicators such as image URLs, host relationships, filenames, duplicate use, alternative text and patterns associated with known stock or third-party sources. Scope limits may change to protect service availability.

3.2 Full PDF report

The paid report is a manually reviewed technical inventory covering the scope stated at checkout, currently up to 25 public pages and 250 image references unless agreed otherwise. It normally includes page locations, image-source indicators, prioritised review items and an evidence checklist. Delivery is within the timeframe confirmed with your order.

3.3 Image creation bundles

Image bundles provide the number of AI-assisted, human-reviewed, web-ready images stated at checkout from one coherent brief. Unless expressly agreed otherwise, one light revision across the batch is included. A light revision means reasonable prompt, crop, colour or minor compositional adjustments; it does not include a new concept, photography, detailed hand illustration, brand strategy, editable source files, model or property releases, or unlimited revisions.

4. What a scan or report cannot establish

Image matching and source indicators are imperfect. A flag is a prompt to review evidence; it is not a finding of infringement. We do not warrant that a scan or report will:

5. Your authority and responsibilities

You may submit only a website that you own, operate, administer or have the owner’s express permission to scan. You must not use ImageSure to probe private systems, bypass access controls, overload a service, harvest data, test vulnerabilities, monitor another person or interfere with a website.

You are responsible for the accuracy of all URLs, briefs, instructions and evidence you supply. You must preserve relevant records and make your own decision about removing, licensing, replacing or continuing to use an image.

6. Orders, prices and payment

Prices are shown in euros. Any applicable VAT, sales tax or similar charge will be displayed or handled at checkout where required. Payment is due when the order is placed and is processed by the payment provider identified at checkout. We do not normally receive or store full card details.

An automated receipt is not acceptance if there is an obvious pricing error, unlawful brief, technical impossibility or lack of capacity. If we cannot accept an order, we will refund amounts paid for the unperformed service.

7. Delivery, briefs and revisions

Delivery dates are estimates unless we expressly agree a fixed deadline in writing. Delay caused by an incomplete brief, unavailable website, blocking, missing access, late feedback or events outside our reasonable control extends the delivery period.

You must review delivered files promptly and describe any objective defect or included revision request within seven days. Approval, publication or failure to respond after a reasonable reminder may be treated as acceptance, without limiting mandatory consumer rights.

8. Cancellation and refunds

You may cancel a paid service before work begins and receive a refund, less any non-refundable payment-processing charge where lawful. Once custom report or image work has begun, we may retain a reasonable amount for work already performed.

If you are an EEA or UK consumer and a statutory cancellation period applies, we will obtain any consent or acknowledgement required before starting immediately. If you expressly request performance during that period, you may have to pay for work performed before cancellation; once a digital service is fully supplied or bespoke content completed, the right to cancel may be lost where the law permits. Nothing in these terms removes rights that cannot lawfully be excluded, including remedies for a defective service.

9. Rights in reports and created images

We retain ownership of our platform, scanner code, report structure, methods, branding and reusable know-how. After full payment, we grant you a worldwide, perpetual, non-exclusive right to use the delivered report internally and to share it with your professional advisers for your own matter.

After full payment, we grant you a worldwide, perpetual right to use, reproduce, adapt and publish delivered image outputs for lawful business and marketing purposes, subject to these terms and any clearly disclosed third-party provider terms. Because image bundles may be AI-assisted, similar outputs may exist, exclusive rights may not be available, and copyright registration or enforceability is not guaranteed. We do not assign rights that we do not own.

You must review outputs before use. You are responsible for obtaining specialist clearance if an output may include a recognisable person, trade mark, product design, artwork, location, confidential material or other third-party right.

10. Brief restrictions

You must not request unlawful, deceptive, defamatory, infringing, hateful, exploitative or privacy-invasive content; sexual content involving minors; impersonation intended to mislead; or content that violates a provider’s acceptable-use rules. You confirm that you have permission to supply all reference images, logos, personal data and other materials in your brief.

We may reject, pause or cancel a brief that creates legal, safety, technical or reputational risk. If the issue is not caused by your breach, we will refund the unperformed portion.

11. Third-party services

The service may rely on hosting, crawling, security, payment, email, ecommerce and AI-generation providers. Their availability and terms can affect delivery. Links or references to Copytrack, PicRights, Pixsy, Visual Rights Group, ImageRights, Copyright Agent, Getty Images, PicScout or any other organisation are for identification and information only. ImageSure is independent and is not affiliated with or endorsed by them.

12. Availability and changes

We may maintain, secure, update, limit or discontinue free functionality. We do not guarantee uninterrupted or error-free access. We may update these terms prospectively by publishing a revised date; material changes affecting an existing paid order will not apply retroactively unless required by law or agreed with you.

13. Disclaimers

To the fullest extent permitted by law, services are supplied using reasonable care and skill but without any promise of a particular legal, commercial or enforcement outcome. We exclude implied warranties only to the extent they may lawfully be excluded. Public website content is general information and may become incomplete or outdated.

14. Liability

Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.

Subject to that sentence, we are not liable for indirect or consequential loss; lost profit, revenue, opportunity, goodwill or anticipated savings; loss arising from a third-party copyright demand; or loss caused by inaccurate user information, missing evidence, an unavailable target website or use contrary to these terms.

For business users, our total aggregate liability arising from a paid service is limited to the greater of €100 or the amount you paid us for the affected service in the 12 months before the event giving rise to the claim. The limit does not apply where prohibited by law. Free services are provided without monetary liability to the fullest extent permitted by law.

15. Indemnity for misuse

If you use the service for a website you are not authorised to scan, supply materials you have no right to use, or use an output unlawfully, you will reimburse reasonable losses, claims and costs we incur as a direct result, to the extent permitted by law and subject to our duty to mitigate. This clause does not apply to consumers where it would be unfair or unlawful.

16. Data protection and confidentiality

Our processing of personal data is described in the Privacy Policy. We will use reasonable care with non-public briefs and order files, but you should not submit unnecessary confidential or sensitive personal information.

17. Suspension and termination

We may suspend or terminate access for material breach, fraud, abuse, security risk, non-payment or unlawful use. Where reasonable, we will give notice and an opportunity to remedy the breach. Clauses intended to survive—such as payment, rights, disclaimers, liability and dispute provisions—continue after termination.

18. General terms

If one provision is unenforceable, the remainder continues. A delay in enforcing a right is not a waiver. You may not transfer a paid service without our consent; we may transfer the business or these terms as part of a sale or reorganisation provided your rights are not reduced. These terms, the order details and the Privacy Policy form the agreement for the service and replace prior statements about it.

19. Governing law and disputes

These terms and non-contractual disputes are governed by [Add governing law and courts in ImageSure Setup]. If you are a consumer, mandatory protections and court rights in your country of residence remain available. Please contact us first so we can try to resolve a concern. Nothing prevents either party seeking urgent protective relief or using a competent consumer dispute body where applicable.
